Distance Sales Agreement

1. PARTIES

This Distance Sales Agreement ("Agreement") is entered into by and between PUKKA Seyahat Turizm Yatçılık Taşımacılık Ticaret Limited Şirketi (Gunesh Axtra Travel Agency), located at Kumbahçe Mahallesi, Atatürk Caddesi No.:83/1, Bodrum/Muğla ("Seller"), and the Buyer, who purchases services via www.axtratravel.com ("Website").

The Seller and Buyer shall be referred to individually as a "Party" and collectively as the "Parties" in this Agreement.

2. DEFINITIONS

• Cookie Policy: A policy providing information about cookies used to improve website functionality and user experience.
• Privacy & Personal Data Protection Policy: The policy detailing how the Buyer’s personal data is processed by the Seller.
• Service: Tours, transfers, hotel reservations, transportation, and other travel services provided through the Website.
• Buyer: The individual or entity purchasing services through the Website.
• Personal Data: Any information that directly or indirectly identifies an individual.
• KVKK: Personal Data Protection Law No. 6698 of Turkey.

3. SCOPE & SUBJECT OF THE AGREEMENT

This Agreement outlines the rights and obligations of the Parties concerning reservations or purchases made electronically via www.axtratravel.com.

This Agreement complies with the Consumer Protection Law No. 6502 and the Distance Sales Regulation.

4. SERVICES & DELIVERY

The Buyer acknowledges and agrees to the content, scope, pricing, and delivery conditions of the purchased services as described on the Website.

Service Delivery

• The purchased service is provided within the specified date and time.
• If the Buyer requests transfer of service to another person, the request will be evaluated and approved at the Seller’s discretion.

5. RIGHT OF WITHDRAWAL & CANCELLATION POLICY

5.1. General Rules

• The Buyer may cancel a service up to 48 hours before the scheduled date.
• Cancellations made between 48 and 24 hours before the service receive a 50% refund.
• No refunds will be issued for cancellations made within 24 hours of the service.
• For bookings during national holidays and peak periods, cancellations must be made at least 7 days in advance to receive a 90% refund.

5.2. Special Cases

• If the Seller cancels the service due to force majeure (unforeseen circumstances), the full amount will be refunded within 5 business days.
• Cancellation requests must be made by the person who made the booking and communicated directly to the Seller.

6. RIGHTS & OBLIGATIONS OF THE PARTIES

• The Buyer must provide accurate and up-to-date information when making a reservation.
• The Buyer is responsible for all transactions and communications conducted on the Website.
• The Seller may be required by law to share user data with authorized authorities.
• The Buyer agrees not to misuse promotions or discounts for unfair advantages.

7. INTELLECTUAL PROPERTY RIGHTS

• The design, software, content, domain, and trademarks on the Website are the property of the Seller.
• The Buyer is prohibited from copying, publishing, or using any content without written permission.

8. TERMINATION OF AGREEMENT

• Either Party may terminate this Agreement unilaterally at any time without liability.
• The Seller reserves the right to cancel reservations or suspend accounts if the Buyer violates the Agreement or misuses the Website.

9. FORCE MAJEURE

• Events such as earthquakes, floods, wars, terrorism, pandemics, transportation disruptions, technical failures, and strikes may prevent the Seller from providing services.
• In such cases, the Seller is not responsible for service disruptions, and supplier conditions will apply.

10. DISPUTE RESOLUTION

• Consumer Arbitration Committees and Consumer Courts have jurisdiction over disputes arising from this Agreement.
• All transactions are subject to Turkish Law.
